<p>While there are some similarities between <em>SIPPs</em> and <em>QROPS</em>, there are some integral differences that need to be understood too. SIPPS stands for Self Invested Personal Pension, and in reality a QROPS is a type of SIPP. Both of these pension options allow you to pay funds into them and offer some degree of investment flexibility. However, a QROPS is only available to people who are intending to leave the UK on a permanent basis &#8211; conversely, a SIPP can be held if you live away from the UK but have the intention to repatriate.</p>
<p>If you choose to invest in a SIPP, you will be entitled to tax relief on your contributions. Also, <span style="text-decoration: underline;">SIPPs</span> tend to be less expensive to enter than <span style="text-decoration: underline;">QROPS</span>, despite the general reductions in QROPS costs. In essence, a SIPP is the ideal pension choice if you wish to enjoy flexibility and stay in control of your money &#8211; but for expats living abroad, you need to be sure that you&#8217;re going to be returning to the UK.</p>
<h2>Proposed QROPS changes could make SIPPs a better option</h2>
<p>We&#8217;ve recently posted some articles on our news pages regarding proposed changes to QROPS. Although these changes have not yet been confirmed, there’s a good chance that from April 2012, in order to benefit from QROPS, your pension funds would need to be held outside of the UK for a minimum of 10 years &#8211; otherwise it will be treated in the same way as a UK pension. If you&#8217;re planning to take pension benefits within a 10 year period, you&#8217;re probably better off opting for the lower cost SIPP option.</p>
<p>Whether you ultimately decided to go for a <a title="QROPS " href="http://www.guardianwealthmanagement.com/qrops/">SIPP or a QROPS</a> , professional advice from a financial adviser is essential. Your financial adviser can help you to build and rebalance your SIPP investments, and a SIPP will allow you to pay in as much money as you wish whenever you want. If you&#8217;re working abroad as an expat, your salary may be higher than an equivalent position in the UK &#8211; with a SIPP, you can add this increase in income or any bonuses to your pension pot, with the option to reduce your contributions when you return to the UK. This differs from a traditional pension in that there&#8217;s no commitment to keep your contributions at a certain level.</p>

			<content:encoded><![CDATA[<p>In the world of finance, it seems that nothing ever stays still for long &#8211; the latest proposed changes could have a big effect on expats who wish to transfer their UK pensions into a <strong>QROPS</strong>, or Qualifying Recognised Overseas Pension Scheme.</p>
<p>HMRC has published a detailed proposal outlining the changes that they wish to make in regards to <em>QROPS</em>, including a big change in reporting responsibilities. Since their introduction, some QROPS have been subject to investigation by HMRC due to poor conduct; the latest proposals are an attempt to revise the various conditions that each <span style="text-decoration: underline;">QROPS</span> has to meet in order to be approved, and to seek a higher level of compliance to try to ensure that schemes are not abused. The objectives of the proposed legislative changes to QROPS are also an attempt to ensure fair taxation of transfers.</p>
<h2>What Would Changes in QROPS Legislation Mean?</h2>
<p>The changes as proposed on 7th December 2011, have been issued under the Finance Act 2012 draft <strong>legislation</strong> and while some new proposals were certainly not unexpected by the finance and pensions industry, the immediate reaction to these proposals seems to present concerns as to the impact of these changes if they are to go ahead. The main changes proposed include:</p>
<ul>
<li>Reporting &#8211; it used to be that when transferring your UK pension into a QROPS, you were required to report to HMRC for a period of five years after leaving the UK. If the proposed changes to <em>legislation</em> are approved, this reporting period will be extended to 10 years.</li>
<li>Tax charges – every QROPS must be recognised by their own source country in regards to tax.</li>
<li>Acknowledgement &#8211; the proposed changes to QROPS legislation would mean that anybody wishing to transfer their pension into a QROPS must first make an official acknowledgement of the potential tax implications regarding the transfer.</li>
</ul>
<p>Following the announcement of these proposed changes to QROPS legislation, there will now be an eight week consultation period, which is due to end on 31st January 2012. If passed, it may cause significant changes in regards to the tax benefits that QROPS can currently offer to expats and could result in any tax exemption offered by the QROPS only being able to continue if the same rules apply to both non-residents and residents of the scheme’s jurisdiction.</p>
<p>Whether or not the consultation brings about any amendments to the proposed legislative changes, the final results will come into effect as of 6th April 2012.</p>

<p>The <strong>Robin Cosgrove Prize for Innovative Ideas for Ethics in Finance</strong> gives young people across the world the chance to put forward their own ideas regarding the financial industry. With the current state of the world economy, and the financial crisis that seems no closer to becoming resolved, this prize for ethics in finance has real relevance. The submissions to this year’s prize were of an incredibly high quality, and the process is an opportunity for young people involved in the financial industry to have their say regarding the continuing problems in the financial services sector.
